Disciplinary proceedings – Issue of final order / review
instructions – Issued.
Instances have come to the notice of this department that most of
the Heads of Departments / Offices and the Administrative Secretariats
who are acting as Disciplinary Authorities and Appellate Authorities are
not following the time schedule for disposal of disciplinary proceedings
against officials and other instructions communicated in this
department’s I.D.note / Memorandum No.C.13015/18/93-C.V.O dated
27.11.98.
The said instruction is once again communicated for strict
compliance in future.
Further, in some cases, it is noticed that due to delay in
dealing with the disciplinary cases, the delinquent officials are left
scot free to go on voluntary retirement etc which complicates and make
the continuance of disciplinary proceedings a laborious task.
In certain cases, the delay cost the
government exchequer by way of paying penal interest etc.
In some other cases, the delay in issue of chargesheet /
prosecution sanctions had resulted in giving promotions to the officials
who are facing grave charges against them and this causes embarrassment
to the government.
Further, it is also stated as one of the reasons for the delay in
issue of charge sheet is that the file has been referred to Law
Department for advice / Clarification / Vetting.
It is the responsibility of the concerned Disciplinary Authority
to see that the files are got cleared from Law Department at the
shortest possible time in the light of the instructions above.
Time and again, the Central Vigilance Commission, New Delhi is
also pulling this administration for such delays.
This causes uncomfortable position during review meetings
conducted by the Central Vigilance Commission.
2.In view of the above, all the Heads of Departments / Offices /
Administrative Secretariats who are acting as Disciplinary Authorities /
Appellate Authorities are strictly directed to stick on to the time
schedule / instructions communicated in this department’s I.D.note /
Memorandum No.C.13015/18/93-C.V.O dated 27.11.98 (copy enclosed) and
follow up the disciplinary proceedings personally.
If any delay is noticed, the matter will be viewed seriously and
action will be taken against those who are responsible for the delay.
