Delay in implementation of Commission’s advice.
The Central Vigilance Commission, New Delhi
in its recent communication has stated that a large number of advices from the Commission
at both first and second stage pending implementation for long
periods. And a reasonable
time limit for concluding and finalizing vigilance cases had already
been built in the procedure for disciplinary proceedings.
Besides the responsibility for ensuring quick disposal of
disciplinary proceedings rest with the administration and the vigilance
department cannot be called in to share it at the advice implementation
stage. Therefore
administration must appreciate that it will be called upon to explain
inordinate delay over and above the prescribed time limits for
finalizing disciplinary cases. Hence,
the Central Vigilance Commission has stated that subsequent to its first
and second stage advice the responsibility for finalization and award of
punishment passes on from the vigilance to the personnel department.
Further, the Central Vigilance Commission has directed to impress
upon all concerned and especially the personnel departmental that in
view of the shift in responsibility from the vigilance to the personnel,
any delay over and above the prescribed time limits for finalization of
disciplinary cases will be viewed as misconduct by the Commission and
will render the concerned officials of the personnel department and
others concerned liable for being proceeded from the vigilance angle
with its attendant ramification.
Hence, the Secretariat
Departments/Heads of Departments/Head of Offices are directed to comply
with time schedule and ensure all disciplinary proceedings are disposed
off in time. In case of failure, action will be taken as stated in para
2 above.
